Welcome to Emerald Legacy.
These Terms of Service (“Terms”) govern your access to and use of the Emerald Legacy website, including EmeraldLegacyClub.com, our online store, products, content, videos, community features, customer accounts, promotions, and other services made available through the website (collectively, the “Services”).
The Services are operated by Green Horizon Press LLC, doing business as Emerald Legacy (“Emerald Legacy,” “we,” “us,” or “our”).
By accessing or using the Services, creating an account, submitting content, or purchasing products through the website, you agree to these Terms and our Privacy Policy and, where applicable, our Refund & Return Policy.
If you do not agree to these Terms, please do not use the Services.
1. AGE REQUIREMENTS
The Emerald Legacy game is intended for persons 21 years of age or older.
You must be at least 21 years old to purchase the Emerald Legacy game through our website.
By purchasing the game, you represent that you are at least 21 years old and legally capable of entering into a binding agreement.
Other products, content, or areas of the website may be subject to different age requirements where expressly stated.
Emerald Legacy is an entertainment product. The 21+ designation reflects, among other things, the game's mature themes and cannabis-industry subject matter. Neither the game nor this website sells, distributes, delivers, or facilitates the purchase or sale of cannabis or controlled substances.
2. ONLINE STORE
Our website allows customers to purchase Emerald Legacy games, apparel, accessories, and other merchandise that we may offer from time to time.
All purchases are subject to product availability and our acceptance of your order.
We reserve the right, to the extent permitted by law, to limit quantities, refuse or cancel orders, discontinue products, modify product offerings, and restrict sales when reasonably necessary, including suspected fraud, unauthorized resale, pricing errors, inventory limitations, or misuse of our Services.
Submission of an order does not necessarily constitute our acceptance of that order.
3. PRODUCT INFORMATION
We make reasonable efforts to display our products accurately, including descriptions, photographs, colors, components, specifications, pricing, and availability.
However, displays and colors may vary depending on your device, screen, settings, lighting, manufacturing variations, or other factors.
Product packaging, artwork, components, designs, features, and specifications may change from time to time.
We reserve the right to correct typographical errors, inaccuracies, omissions, pricing errors, and product-information errors, subject to applicable law.
4. PRICING AND PAYMENT
Prices are displayed in the currency identified at checkout and may change without notice.
Applicable taxes, shipping charges, duties, customs charges, and other fees may be added where appropriate.
You agree to provide current, complete, and accurate billing, payment, shipping, and account information.
By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges associated with your order.
Payments may be processed by third-party payment processors. Your use of those payment services may also be subject to the processor's terms and privacy practices.
5. SHIPPING
Continental United States
Game orders containing at least one eligible Emerald Legacy game currently qualify for free standard shipping within the continental United States, unless otherwise stated at checkout or in connection with a particular promotion.
Orders containing apparel only are subject to applicable shipping charges displayed at checkout.
International Orders
International orders are subject to applicable shipping charges, including orders containing an Emerald Legacy game.
International customers may also be responsible for customs duties, import taxes, tariffs, brokerage fees, or other governmental charges imposed by the destination country. Unless expressly stated otherwise, these charges are the customer's responsibility.
Shipping offers, rates, carriers, destinations, and delivery methods may be modified from time to time.
Estimated delivery dates are estimates rather than guarantees except where expressly stated otherwise, and all shipping practices remain subject to applicable law.
6. RETURNS AND REFUNDS
Returns, refunds, damaged products, defective products, missing components, apparel returns, and related matters are governed by our Refund & Return Policy, which is incorporated into these Terms by reference.
Please review that policy before making a purchase.
7. EMERALD LEGACY INTELLECTUAL PROPERTY
The Emerald Legacy brand and the creative work behind it are valuable intellectual property.
Except where otherwise indicated, the website and its contents—including the Emerald Legacy name, logos, trademarks, game board, game design, artwork, graphics, characters, card designs, game components, packaging, photographs, videos, commercials, written materials, website designs, slogans, audiovisual materials, promotional materials, and other content—are owned by or licensed to Green Horizon Press LLC and are protected by applicable intellectual-property laws.
Purchasing an Emerald Legacy game or other product gives you ownership of the physical product purchased. It does not transfer ownership of Emerald Legacy's intellectual property.
Unless expressly authorized by us in writing, you may not reproduce, copy, manufacture, publish, distribute, sell, license, commercially exploit, modify, create unauthorized derivative works from, or otherwise use Emerald Legacy intellectual property for commercial purposes.
You may not use Emerald Legacy's trademarks, branding, artwork, photography, game materials, or other proprietary content in a manner that falsely suggests sponsorship, affiliation, endorsement, authorization, or partnership.
Nothing in these Terms grants you any license or intellectual-property rights except the limited right to access and use the Services for their intended lawful purposes.
8. PERSONAL AND COMMERCIAL USE
The website and its content are provided primarily for personal, noncommercial use unless we expressly authorize otherwise.
You may not systematically download, scrape, harvest, copy, reproduce, republish, or commercially exploit website content or product information without our written authorization.
You may not use automated systems, bots, scraping tools, data-mining technologies, or similar methods to extract content or information from the Services where prohibited by law or these Terms.
9. USER ACCOUNTS
Certain areas of the website may allow or require you to create an account.
You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.
You agree to provide accurate information and promptly update it when necessary.
You must notify us if you believe your account has been accessed or used without authorization.
We may suspend or terminate accounts that violate these Terms, threaten the security or integrity of the Services, engage in fraudulent activity, or otherwise misuse the Services, subject to applicable law.
10. CUSTOMER REVIEWS, PHOTOS, VIDEOS AND OTHER USER CONTENT
The Services may allow users to submit reviews, photographs, videos, comments, testimonials, feedback, suggestions, or other material (“User Content”).
You retain ownership of your User Content.
However, by submitting User Content through our Services, you grant Green Horizon Press LLC a non-exclusive, worldwide, royalty-free, sublicensable and transferable license to host, store, reproduce, display, publish, distribute, adapt, format, and otherwise use that User Content in connection with operating, promoting, advertising, and marketing Emerald Legacy and our products and Services, subject to applicable law.
This permission includes use through our website, email marketing, social media, digital advertising, and other Emerald Legacy promotional channels.
You represent that you own or have the necessary rights and permissions to submit the User Content and grant us these rights.
You may not submit content that infringes another person's intellectual-property, privacy, publicity, or other rights; contains unlawful or malicious material; impersonates another person; is knowingly false or deceptive; or violates applicable law.
We may moderate, refuse, remove, or restrict User Content where permitted by law and consistent with applicable consumer-review protections.
Importantly, Emerald Legacy will not require consumers to surrender their right to provide truthful negative reviews merely because we disagree with them. The FTC notes that the Consumer Review Fairness Act protects consumers' ability to share honest opinions about products and businesses.
11. REVIEWS AND TESTIMONIALS
Reviews and testimonials represent the experiences and opinions of the individuals providing them.
We do not guarantee that every customer will have the same experience.
Users may not knowingly submit fake, fraudulent, misleading, or fabricated reviews or impersonate another customer.
If a review or endorsement is incentivized, sponsored, submitted by an affiliate, or otherwise involves a material connection to Emerald Legacy, appropriate disclosures may be required.
Federal guidance requires material relationships between endorsers and brands to be clearly and conspicuously disclosed.
12. EMERALD LEGACY CLUB
Users may have the opportunity to join the Emerald Legacy Club and receive newsletters, announcements, product information, apparel-drop information, event opportunities, discounts, promotions, and other Emerald Legacy communications.
Joining the Emerald Legacy Club does not guarantee access to any particular product, event, discount, opportunity, apparel release, inventory allocation, or benefit unless expressly stated.
Availability may be limited.
You may unsubscribe from marketing emails using the unsubscribe mechanism provided in those communications.
If Emerald Legacy later introduces a paid, automatically renewing membership or subscription, additional terms and disclosures will be provided before enrollment as required by applicable law. California imposes specific consent, disclosure, reminder, and cancellation requirements on automatic-renewal and continuous-service programs.
13. LEGACY SALES NETWORK
Emerald Legacy may operate the Legacy Sales Network, through which approved participants can promote eligible Emerald Legacy products and potentially earn commissions on qualifying sales.
Participation is subject to application, approval, and a separate Legacy Sales Network/Affiliate Agreement.
Participation in the Legacy Sales Network does not make a participant an employee, partner, joint venturer, franchisee, legal representative, or agent of Green Horizon Press LLC.
Legacy Sales Network participants are independent contractors and have no authority to enter into agreements, incur obligations, make warranties, approve refunds, or otherwise bind Green Horizon Press LLC unless expressly authorized in writing.
Commission terms, eligible transactions, payment schedules, reversals, deductions, marketing requirements, disclosure obligations, taxes, termination, and other program rules will be governed by the separate Legacy Sales Network Agreement.
Where a commission has already been paid on a transaction that is subsequently refunded, charged back, cancelled, determined to be fraudulent, or otherwise determined to be ineligible, applicable program rules may permit the amount to be deducted from future commissions or otherwise recovered.
Affiliate participants must clearly disclose their financial relationship with Emerald Legacy when required by law. FTC guidance specifically states that affiliate marketers should clearly and conspicuously disclose when they receive commissions from purchases through their links.
14. PROMOTIONS, CONTESTS AND GIVEAWAYS
Emerald Legacy may occasionally offer promotions, sweepstakes, contests, giveaways, discounts, VIP opportunities, or similar programs through the website, email, social media, events, or other channels.
These promotions may be subject to separate Official Rules, eligibility requirements, geographic restrictions, age restrictions, deadlines, and other terms.
If separate promotion rules conflict with these Terms concerning that promotion, the promotion-specific rules will control.
Participation is void where prohibited by law.
15. VIDEOS AND EDUCATIONAL CONTENT
Emerald Legacy may provide commercials, founder videos, setup videos, gameplay demonstrations, instructional materials, entertainment content, and other videos or information.
These materials are provided for general informational, promotional, educational, and entertainment purposes.
Gameplay demonstrations and videos may not depict every possible situation, interpretation, rule interaction, product variation, or component.
Where applicable, official game rules and materials accompanying the product should be consulted for gameplay.
16. CANNABIS-THEMED CONTENT DISCLAIMER
Emerald Legacy is a board game and entertainment brand.
References to cannabis, dispensaries, cultivation, distribution, cannabis businesses, transactions, industry situations, or similar subjects within the game, videos, website, or promotional materials are fictionalized, educational, satirical, thematic, or entertainment-oriented unless expressly stated otherwise.
Green Horizon Press LLC does not sell or distribute cannabis through the Emerald Legacy website.
Nothing contained in the game, website, videos, community content, or other Services constitutes legal, regulatory, licensing, financial, investment, tax, medical, cannabis-industry, or other professional advice.
You are responsible for complying with laws applicable to your own activities and jurisdiction.
17. PROHIBITED USE
You may not use the Services to engage in unlawful activity; commit or facilitate fraud; infringe intellectual-property rights; upload malicious software; interfere with website security or operation; gain unauthorized access to accounts or systems; impersonate others; collect information about other users unlawfully; send spam or malicious communications; circumvent security measures; manipulate reviews or promotions; or otherwise misuse the Services.
We reserve the right to investigate suspected violations and take appropriate action consistent with applicable law.
18. THIRD-PARTY SERVICES
Our website may integrate with or rely upon third-party providers for functions such as ecommerce, payment processing, shipping, analytics, email communications, reviews, affiliate tracking and management, website hosting, and other services.
This may include services such as the UpPromote affiliate platform.
Third-party services operate under their own terms and privacy practices.
Green Horizon Press LLC does not control every aspect of third-party services and, to the extent permitted by law, is not responsible for independent third-party acts, omissions, availability, security, or content.
19. THIRD-PARTY LINKS
The Services may contain links to third-party websites, social-media platforms, services, or resources.
Links are provided for convenience and do not necessarily constitute our endorsement of the third party.
Your interactions with third-party websites and services are governed by their applicable terms and policies.
20. WEBSITE AVAILABILITY
We work to keep the Services available and functioning properly, but we do not guarantee uninterrupted or error-free access.
The website may occasionally be unavailable because of maintenance, updates, technical problems, security issues, third-party outages, or circumstances outside our reasonable control.
We may modify, suspend, discontinue, or update portions of the Services from time to time.
21. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND WEBSITE CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
GREEN HORIZON PRESS LLC DISCLAIMS WARRANTIES NOT EXPRESSLY PROVIDED BY US, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT SUCH DISCLAIMERS ARE PERMITTED BY LAW.
NOTHING IN THESE TERMS EXCLUDES WARRANTIES OR RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.
22. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GREEN HORIZON PRESS LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, EXCEPT TO THE EXTENT SUCH LIABILITY CANNOT LAWFULLY BE LIMITED OR EXCLUDED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GREEN HORIZON PRESS LLC'S AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICES OR A PRODUCT PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID TO GREEN HORIZON PRESS LLC FOR THE PRODUCT OR TRANSACTION GIVING RISE TO THE CLAIM.
Some jurisdictions do not permit certain exclusions or limitations of liability, so portions of this section may not apply to you.
23. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Green Horizon Press LLC and its officers, owners, employees, contractors, and agents from third-party claims, liabilities, damages, losses, and reasonable expenses arising from your unlawful misuse of the Services, violation of these Terms, infringement of another person's rights, or User Content you submit.
24. TERMINATION
We may suspend or terminate access to the Services or an account where reasonably necessary because of fraud, unlawful activity, security threats, material violations of these Terms, or abuse of the Services.
Termination does not eliminate obligations or rights that by their nature should survive termination, including intellectual-property provisions, payment obligations, disclaimers, liability limitations, and dispute provisions.
25. GOVERNING LAW AND DISPUTES
These Terms and disputes arising from them will be governed by the laws of the State of California, without regard to conflict-of-law principles, except where federal law or other applicable law controls.
Subject to applicable law, disputes arising out of or relating to these Terms or the Services that cannot be resolved informally will be brought in an appropriate state or federal court located in Los Angeles County, California, and the parties consent to jurisdiction and venue there.
Nothing in this section deprives a consumer of protections or rights that cannot lawfully be waived.
26. CHANGES TO THESE TERMS
We may update these Terms periodically to reflect changes to our Services, business practices, products, technology, or applicable requirements.
When we make changes, we will update the “Last Updated” date.
Where required by applicable law, we will provide additional notice or obtain consent before materially revised terms become effective.
Your continued use of the Services after revised Terms become effective constitutes acceptance to the extent permitted by law.
27. SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as appropriate, and the remaining provisions will remain in effect.
28. NO WAIVER
Our failure to enforce a provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.
29. ENTIRE AGREEMENT
These Terms, together with policies and additional terms expressly incorporated by reference, constitute the agreement between you and Green Horizon Press LLC regarding the Services covered by them.
Separate agreements may apply to specific programs, including the Legacy Sales Network.
